These Terms & Conditions govern your use of the My Travel Expert website and any travel planning, booking, or related services we provide. My Travel Expert is a trade name operated by My Travel Expert LLC ("My Travel Expert," "we," "us," or "our"), an independent travel agency affiliated with our host agency, Legato. By using our website, requesting a quote, or booking travel through us, you ("you," the "client," or "traveler") agree to these Terms. Please read them carefully. If you do not agree, please do not use our services.

1.Our Role as Your Travel Agent

My Travel Expert acts as an independent travel agent and intermediary. We help you plan, arrange, and book travel by connecting you with third-party travel suppliers — including cruise lines, airlines, hotels and resorts, tour operators, transfer and excursion companies, car rental companies, insurance providers, and other vendors (collectively, "Suppliers").

We do not own, operate, manage, or control any Supplier or the travel services they provide. Suppliers are independent businesses. Our role is limited to arranging bookings on your behalf. Once a booking is made, the travel services themselves are provided directly by the Supplier, subject to that Supplier's own terms and conditions.

Because we act only as your agent in arranging travel, we are not responsible or liable for the acts, errors, omissions, representations, warranties, breaches, negligence, delays, cancellations, schedule changes, overbooking, bankruptcy or insolvency, or the quality, safety, or non-performance of any Supplier, or for any resulting injury, death, damage, loss, delay, or inconvenience.

2.Third-Party Suppliers & Their Terms

All bookings are subject to the terms and conditions of the applicable Supplier, including their rules on payments, deposits, cancellations, refunds, changes, penalties, baggage, conduct, liability, and required travel documents. These Supplier terms are a binding contract between you and the Supplier.

It is your responsibility to read and understand each Supplier's terms before booking and before you travel. We can help you locate them, but we are not a party to that contract and cannot change or waive a Supplier's rules. Where a Supplier's terms conflict with these Terms as to the travel services they provide, the Supplier's terms control for those services.

3.Pricing & Payment

Prices and availability are not guaranteed until your booking is confirmed and paid in full. Quotes are estimates based on information available at the time and may change at any time due to Supplier pricing, availability, currency fluctuations, taxes, fuel surcharges, government fees, or other factors outside our control.

Deposits & final payment: Many bookings require a deposit to hold, with the balance due by a Supplier-set deadline. If final payment is not received by the deadline, the Supplier may cancel your booking and impose penalties. You are responsible for meeting all payment deadlines.

Price increases: Until paid in full, prices remain subject to change by the Supplier, including for taxes, fees, and surcharges. Some Suppliers may pass along increases even after deposit.

Payment processing: Payments for travel are typically made directly to the Supplier or through the Supplier's or host agency's payment systems. You authorize the charges you approve. You are responsible for any fees your bank or card issuer applies (for example, foreign transaction fees).

Chargebacks: Because funds are remitted to Suppliers, you agree to resolve payment disputes with us and the Supplier directly rather than initiating a chargeback, except as permitted by law.

4.Service Fees

Our travel planning is generally offered at no separate cost to you, as we are typically compensated by Suppliers. However, we reserve the right to charge planning, consultation, research, booking, or change fees for certain services, which will be clearly disclosed to you in advance. Any service or planning fees charged by My Travel Expert are separate from Supplier costs and are non-refundable once work has begun, except where required by law.

5.Cancellations, Changes & Refunds

Cancellations and changes are governed by the applicable Supplier's policies. Many travel bookings are non-refundable or carry significant penalties, and some are non-changeable. You are responsible for understanding these policies before you book.

Refunds, if any, are determined solely by the Supplier and are subject to their timelines. We do not control if, when, or how much a Supplier refunds.

Where a refund is issued by a Supplier, it will be returned to you through the original payment method or as the Supplier directs. Processing can take weeks or months.

Any My Travel Expert service or planning fees are non-refundable as described above, even if the Supplier cancels or you cancel.

To request a change or cancellation, contact us as early as possible. We will assist, but we cannot guarantee any particular outcome, refund, or waiver.

6.Travel Protection Insurance

Travel protection insurance is highly recommended for every trip. Travel involves risks — including cancellations, interruptions, medical emergencies, evacuation, and lost or delayed baggage — that can result in significant financial loss. We strongly encourage you to purchase travel protection, and we can provide a customized quote on request.

We are not an insurance company and do not provide insurance advice. Coverage, terms, exclusions, and claims are the sole responsibility of the insurance provider. If you decline travel protection, you do so at your own risk and accept full responsibility for any losses that insurance may have covered. By declining, you release My Travel Expert from any liability for losses that could have been mitigated by coverage.

Health coverage abroad: Your regular health insurance often does not cover you outside the United States. Many U.S. health plans — and Original Medicare in most cases — provide little or no coverage for medical care received abroad, and foreign hospitals frequently require upfront payment regardless of your home coverage. A single medical emergency or evacuation overseas can cost tens of thousands of dollars out of pocket. You are responsible for understanding what your own health insurance does and does not cover while traveling, and we strongly recommend travel protection that includes emergency medical and evacuation coverage for any trip outside the country. My Travel Expert is not responsible for medical costs, evacuation costs, or any related expenses you incur while traveling.

7.Travel Documents & Passports

You are solely responsible for obtaining and carrying all valid travel documents required for your trip, including passports, visas, permits, and identification.

A valid passport is required for travel outside the United States, and it must be valid for at least six (6) months beyond your date of return to the United States. Some countries require additional passport validity or blank pages.

Non-U.S. citizens and permanent residents may have different document requirements and are responsible for confirming them with the appropriate consulate or embassy.

For domestic U.S. air travel, you are responsible for carrying acceptable identification (for example, a REAL ID-compliant license or other TSA-accepted ID).

The name on your travel documents must exactly match the name on your reservations. You are responsible for name-correction fees and any consequences of mismatches.

We are not responsible for denied boarding, denied entry, delays, or losses resulting from missing, expired, or non-compliant documents.

8.Health & Entry Requirements

You are responsible for determining and meeting all health-related entry requirements for your destinations, including any vaccination, testing, or documentation rules. Requirements can change quickly. We recommend consulting your physician and official sources such as the U.S. Centers for Disease Control and Prevention (cdc.gov) and destination government resources. We are not responsible for any consequences arising from unmet health or entry requirements.

9.Travel Advisories & the STEP Program

Government travel advisories may be in effect for your destinations. You are responsible for reviewing current advisories from the U.S. Department of State (travel.state.gov) and assessing your own comfort with any risks. If you choose to travel to a destination under an advisory, you do so voluntarily and assume all associated risks.

For travel outside the United States, we recommend enrolling in the U.S. Department of State's free Smart Traveler Enrollment Program (STEP) at https://step.state.gov/, which provides safety updates and helps the nearest embassy reach you in an emergency.

10.Accuracy of Your Information

You are responsible for providing complete and accurate information for all travelers, including full legal names (as they appear on travel documents), dates of birth, citizenship, contact details, and any special needs. You must review all confirmations, itineraries, and documents promptly and notify us of any errors immediately. We are not responsible for losses, penalties, or missed travel resulting from inaccurate information you provided or from errors you did not report in time.

11.Assumption of Risk & Release

Travel involves inherent risks, including but not limited to illness, injury, accidents, crime, terrorism, civil unrest, weather events, natural disasters, transportation hazards, and disruptions of all kinds. Some activities and excursions carry additional risks. By booking travel through us, you acknowledge and voluntarily assume all such risks on behalf of yourself and anyone in your travel party.

To the fullest extent permitted by law, you release, waive, and discharge My Travel Expert, Positive Pat, LLC, our host agency, and our and their owners, employees, agents, and affiliates from any and all claims, liabilities, damages, or expenses arising out of or relating to your travel or the acts or omissions of any Supplier.

12.Traveler Conduct & Responsibility

How you conduct yourself while traveling is your responsibility, and it can directly affect your trip. Airlines, cruise lines, resorts, tour operators, and other Suppliers each set their own rules of conduct, and destinations have their own laws and customs. Failing to follow them can lead to denied boarding, removal from a cruise or flight, refused service, additional charges, fines, detention, or arrest — with no refund and at your own expense.

You are solely responsible for: • Following all Supplier rules and the laws and customs of the places you visit. • Arriving on time for flights, cruises, tours, and other departures. Missed departures due to late arrival, missed connections, or your own delay are your responsibility. • Your fitness to travel, including meeting any age, health, mobility, or documentation requirements for your trip or activities. • The behavior of any minors or other members of your travel party. • Any damage, penalties, or costs you cause during travel.

Laws and customs vary around the world. Actions that are legal, normal, or harmless at home may be restricted, offensive, or illegal somewhere else — including things like what you say, photograph, wear, eat, drink, or carry, how you behave in public, and which medications you bring. Penalties abroad can be severe and are enforced by local authorities, not the United States. It is your responsibility to research and follow the laws and customs of every place you visit. You accept full responsibility for any legal consequences arising from your conduct while traveling — whether intended or unintended, and whether based on your actual behavior or how local authorities perceive it. My Travel Expert has no control over foreign laws or their enforcement and is not responsible for any detention, fines, penalties, denied entry, or other consequences you face abroad.

If a Supplier denies, delays, cancels, removes, or refuses service to you because of your conduct, documentation, timeliness, or failure to follow their rules or local laws, you are not entitled to a refund from the Supplier or from us, and My Travel Expert is not responsible for any resulting costs, losses, or missed travel. You assume full responsibility for the consequences of your own actions and those of your travel party.

13.Limitation of Liability

To the fullest extent permitted by law:

• My Travel Expert's total liability to you for any claim arising out of or relating to our services or these Terms is limited to the amount of service fees you actually paid to My Travel Expert (not amounts paid to Suppliers) for the booking giving rise to the claim. • We are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost enjoyment, lost time, or lost profits, even if advised of the possibility. • We are not liable for the acts, errors, omissions, or non-performance of any Supplier or third party. • Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14.Force Majeure

We are not liable for any failure or delay in performance, or for any losses, caused by events beyond our reasonable control, including but not limited to acts of God, weather, natural disasters, epidemics or pandemics, government actions or advisories, border closures, war, terrorism, civil unrest, strikes or labor disputes, Supplier insolvency, mechanical or technical failures, or disruptions to transportation, utilities, or communications.

15.Indemnification

You agree to indemnify, defend, and hold harmless My Travel Expert, Positive Pat, LLC, our host agency, and our and their owners, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your travel, your use of our services, your violation of these Terms, or your violation of any Supplier terms or applicable law.

16.Disclaimer of Warranties

Our services and this website are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted or error-free, or that any Supplier information is complete or accurate.

17.Errors & Corrections

Occasionally, information on our website or in a quote may contain typographical errors, inaccuracies, or omissions relating to pricing, availability, or descriptions. We reserve the right to correct any errors and to update information at any time without prior notice, and we are not obligated to honor a quote or booking based on an obvious error.

18.Special Requests

We will pass along special requests (such as room type, bedding, dietary needs, accessibility, or seating) to Suppliers, but these are not guaranteed and are fulfilled at the Supplier's discretion. A request that is not met is not a breach of these Terms.

19.Supplier Issues & Complaints

If a problem arises with the travel services during your trip, you should address it directly with the applicable Supplier at the time, as they are the party providing and controlling those services. We are happy to assist where we can, but many issues can only be resolved by the Supplier. Please share any concerns with us promptly so we can help where possible.

20.Governing Law, Arbitration & Class Action Waiver

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services shall be resolved exclusively through final and binding arbitration administered in Clay County, Missouri, on an individual basis. You and My Travel Expert waive any right to a jury trial and to participate in any class, collective, or representative action. The prevailing party may be entitled to recover reasonable attorneys' fees and costs to the extent permitted by law. If arbitration is unavailable, exclusive venue shall lie in the state or federal courts located in Clay County, Missouri.

21.Seller of Travel Disclosures

Certain states require travel sellers to register and provide specific disclosures. Where applicable to your transaction, the following registrations apply via our host agency:

Registration as a seller of travel does not constitute approval by the state.

22.Accreditation & Host Agency Affiliation

My Travel Expert is an independent agency affiliated with our host agency, Legato. Through this affiliation, bookings are supported by industry accreditations including ARC, IATA, and CLIA — the organizations that set the standards for trusted travel — which help protect your payments and reservations. These accreditations are held by our host agency.

23.Privacy

We collect and use your information as described in our Privacy Policy. By using our services, you consent to that collection and use, including sharing necessary details with Suppliers to complete your bookings. Please review the current Privacy Policy available on our website.

24.Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of your booking applies to that booking. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. Please check the "Last updated" date above.

25.General Provisions

Entire agreement: These Terms, together with any booking-specific terms and Supplier terms, are the entire agreement between you and us regarding our services.

Severability: If any provision is found unenforceable, the remaining provisions stay in effect.

No waiver: Our failure to enforce any provision is not a waiver.

Assignment: You may not assign these Terms; we may assign them to an affiliate or successor.
